The Circle Photography is built on intentional, elevated portrait experiences. These Terms of Service exist to protect both the creative process and the client experience—ensuring clarity, consistency, and mutual respect throughout every stage of working together.
These Terms apply to all services offered by The Circle Photography and are subject to change at any time. Continued use of our website or services constitutes acceptance of the most current version.
These Terms of Service apply to all users of The Circle Photography website and all clients booking services.
Each session requires a signed Photography Agreement (“Contract”) outlining the full details of your booking, including pricing, deliverables, usage rights, scheduling, and session-specific policies.
These Terms serve as a general framework across all services. In the event of any conflict or discrepancy, the signed Contract takes precedence.
If it is determined—by either party—that a selected session does not align with the client’s needs, adjustments may be made. Any changes affecting scope, pricing, or deliverables require a revised or amended Contract before services continue.
A signed Contract and either a non-refundable deposit or full payment (depending on the session type) are required to secure your session date.
Sessions that do not require a deposit must be paid in full at the time of booking.
All payments are processed securely through Pixieset Payments (powered by Stripe or Paypal).
Any remaining balance must be paid according to the schedule outlined in your Contract.
Failure to submit payment as agreed may result in cancellation, rescheduling, or forfeiture of your session date.
Cancellation and rescheduling policies are defined within your signed Contract.
All deposits are non-refundable.
Refunds or credits, if issued, are at the sole discretion of The Circle Photography.
No-shows or last-minute cancellations may result in forfeiture of all payments made.
All images created by The Circle Photography remain its exclusive intellectual property and are protected by copyright law.
Usage rights are granted through your Contract. The primary license types include:
Images may not be materially altered, sold, transferred, or redistributed beyond the scope of the granted license. Cropping and resizing for formatting are permitted unless otherwise stated.
Unless otherwise agreed to in writing, The Circle Photography reserves the right to use images for portfolio, marketing, social media, and promotional purposes.
Final edited images are delivered within 21 business days after proof selection, unless otherwise stated in your Contract.
Proof galleries are delivered according to the timeline outlined in your session details.
RAW or unedited images are not provided unless explicitly agreed to in writing.
All editing reflects The Circle Photography’s signature style. Additional edits or revisions may incur additional fees.
Sessions begin promptly at the scheduled time.
Clients arriving more than 15 minutes late without notice may receive a shortened session or have the session canceled without refund.
Late arrival may impact both session time and final deliverables.
The Circle Photography is not responsible for delays, interruptions, or cancellations caused by circumstances beyond its control, including but not limited to severe weather, illness, emergencies, travel restrictions, or power outages.
In such cases, reasonable efforts will be made to reschedule the session. If rescheduling is not possible, a refund or credit may be issued at the discretion of The Circle Photography.
Final galleries remain available for download for 60 days from the delivery date.
Clients are responsible for downloading and securely backing up their files within this timeframe.
Availability beyond 60 days is not guaranteed.
Clients and their guests are responsible for any damage caused to studio property, equipment, or furnishings during the session.
Repair or replacement costs may be charged in cases of negligence or misuse.
Clients are responsible for arriving prepared and for following any styling or wardrobe guidance provided.
The Circle Photography is not responsible for wardrobe issues, styling concerns, or unprepared appearance.
For best results, on-site outfit changes and preparation items (such as touch-up products) are recommended.
The Circle Photography reserves the right to refuse or discontinue service if a client’s behavior or conduct is unsafe, inappropriate, or inconsistent with studio standards.
In such cases:
The Circle Photography is not liable for any indirect, incidental, or consequential damages arising from the use of its services.
While all reasonable care and precautions are taken, The Circle Photography is not responsible for technical failures, equipment issues, or accidental loss of digital files beyond its control.
In the event the photographer is unable to complete a session due to illness, emergency, or unforeseen circumstance, liability is limited to a reschedule or refund as outlined in the Contract.
Client information is collected solely for communication, scheduling, and service delivery.
We do not sell or share personal information with third parties, except as required for payment processing or service fulfillment.
Sessions involving minors require a parent or legal guardian to be present for the full duration of the session.
All required consent and release forms must be completed prior to the session.
Sessions will not proceed without proper supervision and documentation.
Studio access details, including any accessibility limitations, will be communicated where applicable.
Clients are responsible for ensuring they can safely access the space.
No refunds will be issued due to access limitations not disclosed prior to booking.
By booking, clients acknowledge they have reviewed The Circle Photography portfolio and understand its visual style.
All editing, retouching, and color grading decisions are made at our discretion.
Requests outside of the established style may incur additional fees or may not be accommodated.
Clients and guests may not photograph, record video, or capture behind-the-scenes content during the session without prior approval.
Unauthorized recording may result in immediate termination of the session without refund.
